According to Article 10 of the Consumer Rights Protection Law of the Republic of Latvia, when a buyer places an order using a phone, web, email, or fax, a Distance Contract is concluded between the buyer and the seller.
1.1 Seller – the owner of the online trading site www.albatrossresort.lv , SIA “Albatross SPA”, registration No. 40203382678, legal and postal address: Albatrosa Street 18, Ķesterciems, Engure Parish, Tukums District, LV-3113, which, within the scope of its economic activity, offers and sells goods, services, and gift cards to the Client in accordance with this distance contract, hereinafter referred to as the Contract.
1.2 Client – a natural or legal person who uses the online trading site www.albatrossresort.lv and who makes or could potentially make a purchase or order a service. The buyer can be both a consumer within the meaning of the Consumer Rights Protection Law and a person who is not a consumer. A Client who is a natural person must be at least 18 years of age and have unlimited legal capacity to enter into contractual relations with the Seller.
1.3 The Distance Contract applies to all orders and purchases made on the online trading site www.albatrossresort.lv.
2.1 The Buyer orders, purchases, and pays for, and the Seller delivers and sells goods and services – hotel reservations, pool visits, spa zone visits, gym visits, spa services and procedures, restaurant goods (hereinafter – Goods and Services).
2.2 The Contract is considered concluded when the Buyer has placed an order and made payment for the goods or services in accordance with the terms of the Contract.
2.3 The Seller has the right to unilaterally change and supplement the terms of the Contract. The terms of the Contract that are in force at the time of ordering the goods and services apply to the Buyer when shopping on the online trading site.
2.4 By placing an order, the Buyer confirms that they have read this Contract and the terms contained therein, are aware of them, understand them, and fully agree with them.
3.1 To use the online store’s services and purchase the goods and services offered therein, the Buyer must fill in an application form when placing an order, indicating basic personal data – name, surname, phone number, email address, and residence address.
3.2 When ordering goods, the Client is responsible for providing truthful and accurate information.
3.3 To purchase Goods or Services, add the desired Goods or Services to the shopping cart.
3.4 The prices, specifications, and descriptions of the goods and services offered on the website are indicated next to the Goods and Services.
3.5 By placing an order, the Buyer confirms that they have chosen to purchase the specific Goods or Services under the terms specified in this Contract and confirms that they have read the internal rules of the Albatross SPA complex and agree to comply with them.
3.6 The Client can make hotel reservations, spa procedures, and services, pool visits, spa zone, and gym visit purchases:
3.6.1 every day, 24 hours a day;
3.6.2 confirmation of purchase can be received every day from 09:00 – 21:00.
3.7 Restaurant services – ordering food and reserving tables:
3.7.1 Purchases can be made from Tuesday to Friday from 12:00-20:00; Saturday and Sunday from 10:00 – 20:00;
3.7.2 Confirmation of purchase will be received by the Buyer within 5 minutes after the purchase is made and paid for.
3.8 Gift card purchases:
3.8.1 Purchases can be made every day, 24 hours a day;
3.8.2 The Buyer can receive an electronic Gift Card at the specified email address every day from 9:00-21:00.
3.9 Goods or services will not be provided if the client has not received an order, purchase, or reservation confirmation in the email specified by them.
4.1 The prices of goods and services on the website are indicated in euros (EUR) including VAT. Goods and services are sold to the Buyer at the price in effect on the website at the time of placing the order.
4.2 The Buyer must pay for the Goods and Services at the time of placing the order, choosing one of the payment methods provided by the payment platform:
4.2.1 Online banking;
4.2.2 Card payments;;
4.2.3 Other.
4.3 When purchasing the following services – hotel reservations, spa zone visits, spa services, pool visits, gym visits:
4.3.1 After payment for the purchase is made, the Buyer will receive confirmation within 2 hours about the purchased Goods or Services or the reservation made to the email specified by the Buyer, except during the time from 21:00-09:00.
4.4 When purchasing Gift Cards:
4.4.1 The electronic gift card will be received within 2 hours at the specified email address, except during the time from 21:00-09:00.
4.5 When purchasing goods from the restaurant:
4.5.1 The Seller will contact the Buyer by phone or email within 15 minutes to confirm the order.
4.6 The Contract takes effect upon successful payment to the Seller’s bank account on the website. If, for any reason, the order cannot be fulfilled, the Buyer will be informed and the amount paid will be refunded as soon as possible, but no later than 14 days after receiving the notification.
5.1 The Buyer will receive goods from the restaurant at the Albatross Restaurant, Albatrosa Street 18, Ķesterciems, Engure Parish, Tukums District, LV-3113, according to the order terms.
5.2 For hotel reservations, spa zone visits, spa services, pool and gym visits, and gift card purchases, the Buyer will receive a confirmation or electronic gift card within 2 hours at the specified email address, indicating the name of the service, description of the service, specified time or time period for provision, or the validity period of the gift card.
5.3 The Buyer can receive the reserved hotel or SPA service at the chosen and reserved time at the Albatross SPA leisure complex by presenting the electronic reservation or service confirmation.
5.4 If the Buyer has purchased an electronic gift card, hotel and spa service reservations must be made on the website www.albatrossresort.lv by selecting the service and reserving the available time.
5.4.1 After making a reservation, the Buyer will receive a hotel or SPA service reservation confirmation by email, which must be presented upon arrival at the Albatross SPA leisure complex to receive the service.
6.1 Regarding goods delivered by the restaurant:
6.1.1 The Buyer cannot use the right of withdrawal as the restaurant’s food items are delivered for immediate consumption;
6.1.2 If you wish to cancel or change your order after placing it and receiving confirmation, contact the Albatross restaurant (in person or by phone: 25776644) to find out if it is still possible in the specific case. We do not guarantee that we will be able to make the necessary changes, but we will try.
6.2 Regarding hotel reservations:
6.2.1 The right of withdrawal does not apply to contracts for accommodation services.
6.3 Regarding hotel services – pool visits and gym, spa services, and gift cards:
6.3.1 The Client has the right to withdraw from the purchase within 14 days from the date of purchase if the service has not yet started;
6.3.2 For withdrawal from the purchase, the client must write an application to the Seller’s email:info@albatross-spa.lv;
6.3.3 The Seller will refund the money to the client’s payment card account within 10 business days after receiving the request.
6.4 The right of withdrawal does not apply if the Buyer is a legal entity.
7.1 All disputes arising between the Buyer and the Seller shall be resolved through mutual negotiations or using electronic means of communication in the form of mutual correspondence, but if the disputes cannot be resolved, they shall be resolved in accordance with the regulatory enactments of the Republic of Latvia, in the court of the Republic of Latvia.
7.2 If the Buyer has any complaints about the Goods or Services received, they must submit a corresponding application to the Seller, indicating information identifying the Buyer and the basis of the application. The application should be sent to the Seller’s legal address or electronically to the email:info@albatross-spa.lv.
8.1 By entering the necessary information when placing an order, the Buyer confirms that they have read and agree that their provided data will be used so that the Seller can accept the Buyer’s order and deliver the goods and services following the requirements of regulatory enactments of the Republic of Latvia. By entering the information, the Buyer agrees to the Seller’s processing of personal data for the purpose of concluding the contract for distance sales of goods and services.
8.2 The Buyer acknowledges that it has read the Seller’s Privacy Policy Here, and consents to the processing of his/her personal data necessary for the performance of his/her obligations under this Agreement. The Seller undertakes to use the data obtained by the Customer only for the performance of its obligations under this Agreement.
1. The Albatross SPA Complex Internal Rules are binding for all visitors of the Albatross SPA complex.
2. Before visiting the Albatross SPA complex – hotel, swimming pool, spa area and gym, each client is obliged to carefully read and observe the Internal Rules (hereinafter – the Internal Rules or the Rules).
3. The Internal Regulations shall determine the procedure for the provision of services to Clients, shall determine the safety, hygiene and other requirements to be observed by Clients, and shall also determine the rights, obligations and limitations of liability of Albatross SPA :
4. Terms used in the Regulations:
4.1 Customer – a natural or legal person who visits the Albatross SPA complex and receives one of the services provided by the Albatross SPA complex.
4.2 Company – SIA “Albatross SPA”, registration number: 40203382678, address: 18 Albatrosa Street, Ķesterciems, Engure municipality, Tukuma region, LV-3113.
4.3 Albatross SPA Complex – a Company-owned leisure complex consisting of a hotel, swimming pool, spa area and gym located at Albatrosa iela18, Ķesterciems, Engure municipality, Tukuma region, LV-3113.
4.4 Hotel – a hotel owned by the Company and located in the Albatross SPA complex.
4.5 SPA treatments and services – spa services and treatments provided by Albatross SPA complex, the offer, prices, booking conditions and available times of which can be found on the Company’s website www.albatrossresorts.lv.
4.6 Swimming pool and spa area – The Company-owned swimming pool and spa area located in the Albatross SPA complex.
4.7 Gym – a gym owned by the Company and located in the Albatross SPA complex.
4.8 Services:
5. The Client undertakes to comply with the requirements of the regulatory enactments, incl.
the general requirements of public order and epidemiological safety, fire safety, labour protection and environmental protection normative acts.
6. The Internal Rules are designed to regulate relations, to ensure the well-being of Clients and to avoid unpleasant misunderstandings, injuries and losses.
7. The internal rules of order shall be observed by all Clients regardless of age.
8. Before receiving the services, the person carefully reads and familiarises himself/herself with the Internal Regulations and undertakes to comply with them during the use of the services.
9. The Internal Rules of Procedure shall be drawn up in accordance with the laws and regulations in force in the Republic of Latvia.
10. The Internal Rules and Regulations are posted in the Albatross SPA complex, Albatrosa iela18, Ķesterciems, Engure municipality, Tukuma region, LV-3113 and are available on the website www.albatrossresort.lv.
11. By starting to use the Service, the Customer confirms that he/she has read the Internal Rules and undertakes to comply with them.
12. The Company shall not be liable in any way if a visitor fails to comply with the Internal Rules, instructions of the SPA complex and hotel staff, posted warning signs, signs, causes damage to his/her health, endangers his/her own or other visitors’ health, life, causes material or moral damage to a third party.
13. The Company has the right to ask the Client to leave the Albatross SPA complex if the Client does not comply with these Terms and Conditions.
14. In accordance with the requirements of data protection of natural persons, the Company processes personal data in accordance with the developed Privacy Policy, which can be found on the website albatrossresort.lv or in person at the SPA centre Albatrosa iela 18, Ķesterciems, Engure municipality, Tukuma region, LV-3113.
1. The Client undertakes to observe the internal rules of the Albatross SPA complex and to be courteous to other Clients and service staff.

3. The Client is obliged to inform the hotel management of the loss of or damage to the Client’s private property before checking out of the hotel.
4. The client undertakes to refrain from any action that may endanger his/her own life and health or that of others during his/her stay.
5. The client is obliged to comply with the requirements of the service staff for the maintenance of internal order.
6. The client informs the service staff of any damage to the equipment and inventory in the hotel.
7. Parents or other persons responsible for the child must not leave unsupervised a child under 7 years of age.
8. Smoking, including electronic cigarettes, is not allowed in the hotel or in the hotel rooms.
Smoking is only allowed outside the hotel in designated smoking areas.
The fine for smoking in an unauthorised place, hotel premises or rooms shall be EUR 200.00.
9. The Client undertakes to indemnify the Company against any loss caused to as a result of an act or omission of the Client, his/her dependent or accompanying person.
10. The client has the right to ask the staff for help in case of ill-health, injury, etc.
and immediately call for emergency medical assistance.
11. The Customer may submit a complaint and receive a reply by sending a letter to the Company’s e-mail address info@albatross-spa.lv.
12. If you want to bring your four-legged friend, it must be arranged in advance. A small dog is allowed to stay in the hotel free of charge, but 40 EUR must be paid for a large dog. The penalty for not coordinating the maintenance of a large dog is 200 EUR.

For damage caused by the Customer, the Company will charge the amount of the damage.

3. It is forbidden to disturb the peace of other guests by loud or inappropriate behaviour.
4. It is forbidden to burn candles in the hotel without prior approval or to leave burning candles unattended.
It is forbidden to bring or store inflammable objects and substances in the hotel.
1. The Company shall not be liable for damages, losses incurred by the Customer, if the damages, losses are caused by the actions of third parties or other circumstances for which the Company is not liable under these Terms and Conditions and laws and regulations.
2. Any service personnel shall have the right to instruct Clients to comply with these Terms and Clients shall comply with such instructions.
3. Close individual rooms if necessary.
4. Hotel staff have the right to refuse to serve customers who are under the influence of alcohol or whose behaviour is offensive.
In the above case, no refund will be given for the services booked and paid for.
5. The Company shall not be liable for the belongings of Customers left unattended.
Customers are offered the use of lockable storage facilities (at the reception) free of charge.
1. Clients must visit the pool area in a swimming costume or swimming trunks and clean indoor rubber slippers, with personal washing materials, towel (for swimming pool and sauna).
2. Swimming in the swimming pool is only allowed in swimming trunks.
Children under 3 (three) years of age are only allowed in the Albatross SPA wearing waterproof nappies.
3. Each visitor is responsible for his/her own safety, health, well-being, physical fitness and swimming skills.
The parents or legal representative are responsible for the safety and health of the child.
4 Clients must strictly adhere to the time, place and validity of the subscription.
5. In case of full occupancy of the pool and spa area, the Albatross SPA administration and responsible persons have the right to stop admitting visitors to the pool and spa area.
6. Children under 16 (sixteen) years of age must be accompanied by an adult who, before collecting the key to the changing room, must sign an acknowledgement of responsibility for the child. Adults take full responsibility for the safety of the children and are responsible for their behaviour.
7. If you experience any unpleasant pain, dizziness or discomfort in your head, you should stop using the pool and sauna immediately, inform the staff and contact your doctor.

9. Customers should note that the showers, changing rooms and pool and spa area floors can be wet and slippery, so please take care and move carefully.
10. In the large swimming pool the maximum number of people per lane is 10 (ten) people, in the small swimming pool the maximum number of children is 5 (five) children with their parents or legal guardian.
11. Persons using the services at a reduced price must present the appropriate document.
The special price is for children up to and including 15 years of age, pensioners.
12. For children up to 5 (five) years of age are free of charge.
13. Children under 16 (sixteen) years of age may visit the complex only accompanied by an adult.
14. In the case of lost property, such as: clothing, shoes, valuables, they are stored for a maximum of two weeks.
Forgotten personal hygiene products are not stored, but put in the garbage.
15. The Company shall not be liable for any damage caused by accident, injury or any other cause resulting from the visitor’s negligence or failure to comply with the internal rules of .

The staff of the recreation complex has the right to expel a visitor who is drunk from the premises of the recreation complex on suspicion.
9. Smoking, including electronic cigarettes.

12. Photograph, film, make audio recordings and similar activities on the premises of the leisure complex, copy or otherwise reproduce materials of the leisure complex without the written consent of Albatross SPA.

Albatross SPA staff has the right to refuse the Customer to purchase a single visit to or cancel the subscription if the Customer has not complied with these rules.
4. The Company is not responsible for the Clients’ personal belongings and material valuables left in the lockers and elsewhere in the Albatross SPA complex.
5. The Customer shall use the changing lockers only during the visit to Albatross SPA.
1. Albatross SPA clients arrive no earlier than 5 (five) minutes before the service time specified in the reservation.
2. Albatross SPA provides the service to visitors during the service period specified in the reservation; visitors arriving before or after this period are not provided with the service.
3. Albatross SPA visitors must leave the complex 15 minutes after the end of the service specified in the reservation, without staying in the Albatross SPA premises.
4. Visitors to Albatross SPA are obliged to observe personal hygiene.
5. One individual Albatross SPA visit includes: use of the shower and changing rooms, use of the pool and saunas.
6. If the Visitor rents the entire complex, each guest is obliged to comply with these rules.

2. After purchasing the Subscription, each time before visiting Albatross SPA, the Customer shall register his/her arrival time at – available visit time in the mobile application Bookla or on the website www.albatrossresort.lv.
3. Subscriptions is linked to a specific person, the visitor is not allowed to transfer the subscription code key to another person.
4. If the visitor has handed over the visitor has given the key to the subscription code to another person, Albatross SPA has the right to cancel the visitor’s subscription.
5. Visitors are obliged to present the subscription code key at the same time as a valid identity document.
6. If, due to illness or other reasons, not all of the appointments have been used, the remaining appointments will not be transferred or refunded after the expiry of the subscription.
7. No refunds will be given to persons who have purchased a subscription.

2. Table service is provided by the waiters to whom the Customer hands over their order.
3. Payment for orders is made after the meal, according to the restaurant’s invoice.
4. Payments can be made at the restaurant’s cash desk or to the waiter, in cash or by credit card.
5. If the Customer is not satisfied with the quality of the food or beverages served, the Customer shall inform the Waiter to resolve the situation.
6. The delivery time depends on the restaurant’s availability.
7. The Client, when visiting the Albatross restaurant, undertakes to observe the internal rules of the Albatross SPA complex, as well as to be courteous to other Clients and service staff.
8.Restaurant staff have the right to refuse to serve customers who are under the influence of alcohol or whose behaviour is offensive.
9. The Company shall not be liable for any damages, losses incurred by the Customer, if the damages, losses are caused by the actions of third parties or other circumstances for which the Company is not liable under these Terms and Conditions and laws and regulations.
10. Any Restaurant staff shall have the right to instruct Customers to comply with these Terms and Customers shall comply with such instructions.
11. While in the Restaurant, the Customer undertakes to refrain from any action that may endanger the life and health of himself or others.
12.The client is obliged to comply with the requirements of the service staff for the maintenance of internal order.
13.While in the Restaurant and its premises, the Customer shall not damage or be rude to the Restaurant’s equipment, facilities and premises.
For damage caused by the Customer, the Company will charge the amount of the damage.
14.The Client shall not behave aggressively, inappropriately, loudly, harass or otherwise disturb other Clients and staff.
15. It is forbidden to disturb the peace of other Clients by loud or inappropriate behaviour.
16. Smoking, including electronic cigarettes, shall be permitted only in designated areas.
17.The Company shall not be liable for the belongings of Clients left unattended.
18.The Company shall not be liable in any way if the Customer, while in the restaurant, fails to comply with the General Regulations and instructions of the service staff, posted warning signs, signs, causes harm to his/her health, endangers his/her health or life or other visitors, or causes material or moral damage to a third party.
19.The Company shall not be liable for any damages, losses incurred by the Customer, if the damages, losses are caused by the actions of third parties or other circumstances for which the Company is not liable under these Terms and Conditions and laws and regulations.
